bad surprise - beolab 6000 frets on ebay

Bought a pair of beolab 6000 frets on ebay some days ago.

Seller said frets where technical and optical in !! immaculate !! condition.

Frets arrived today. They were suberb packed, but frets were far away from immaculate condition. One fret has a hole of 2mm on the fabric, both frets have some little threads of fabric visible. Do you know what I mean ?

Wrote the seller immediately after unpacking the items, that both frets do not correspond with what he said on ebay auction, but no reaction so far.

What would you do ? Any recommedation ?

    Thanks

    Hello Martin,

wait a day or two then open a claim via ebay (item not as described). If you paid via paypal it will be easier to get your money back... It favours buyers...If you paid not using paypal - good luck! Sorry to say so, but you will need to send docs (e.g. a generated tiff of the communication with seller if outside ebay) incl. photos of the frets to an ebay mail address. Best is to call ebay - this worked best for me - I once bought a plasma screen that arrived broken and the seller was VERY rude and not helpful at all. I scanned all docs and sent them to ebay and the case was closed in my favor (paypal payment helped though).

Re: bad surprise - beolab 6000 frets on ebay

    Thanks for your answer Ralf.

I think the main problem will be, that I didn't pay through Paypal, as I don't have a Paypal account. The seller even asked to pay through bank transfer instead of Paypal to save costs. At this time he couldn't know that I don't have a Paypal account.

Conversation with the seller was smooth, so no problem was expected from my point of view - until the frets arrived.

Hi Martin, if you didn't use paypal then you will struggle to get any refund.

Ebay have absolutely no powers to make the seller issue you a refund if you pay by bank transfer. If the seller agrees to refund you I would be very reluctant to return the items before any refund is issued. All you have is the threat of leaving negative feedback & if the seller doesn't care then you have very little rcourse I'm afraid.

Re: bad surprise - beolab 6000 frets on ebay

    Thanks Chris.

This is what I expect, as there is no reaction from the seller.

You're right, ebay can not force the seller to give me a refund. The seller will cancel ebay membership and that was it.

I paid nearly 150 Euros for the frets, expecting them in condition as described. This was a fault - I know by now.

The seller is located in germany, so if nothing happens, I will get a lawyer. I have an insurance for these cases.

Hopefully this makes him taking back the frets and give me a refund.

Re: bad surprise - beolab 6000 frets on ebay

Just a thought Martin but were these bought on a "buy it now" sale?

I only ask because in the UK all items listed on "Buy It Now" Ebay sales are subject to "Distance Selling" laws which basically give any buyer the right to return the goods for a full refund regardless of the reasons for doing so - this law doesn't apply to true auctions. Even if the reason for returning the item is simply that you have changed your mind then you are entitled to a refund as long as the item is returned in the same condition as it was received (and within a specified period). This law protects consumers for ANY purchase made either over the internet or by telephone & rightly covers all purchases on ebay through "but it now" sales.

I don't know if these same laws apply in Germany, but if they do then you would have the weight of consumer law on your side. Having said all of this - taking someone to court & actually getting your money back are 2 completely different matters & I wish you the best of luck.

    Chris.

Re: bad surprise - beolab 6000 frets on ebay

    Hey Chris,

no it was a normal auction, no buy it now auction.

The problem is, that the seller wanted to betray from the first time he put the auction online.

He packed the items in a superb packaging with the knowledge that he will send rubish. In the case I'm not happy with the items he will say that it is a transport damage and the items left his home in immaculate condition. For this, he will, of cause, have some witnesses, which saw, that every items was in perfect condition when packed.

I had this kind of case some years ago, when someone send me an empty packaging. It came to court and the betrayer presented two witnesses which said that everything was in the packaging when it left his hands.

    Regards

    Martin

    Martin,

try to get a partial refund (call the seller?!) and sell the frets as damaged - the money you loose (

I know it feels bad but rest assured these things will one day come back to the guy who fooled you - that is something that i believe.

New frets are not that expensive, did you get a quote from a dealer?

    Ralf

PS: You can always leave a bad comment on ebay, too.

Sorry but some info is missing:

The money you loose 100 euro or less is not worth thinking of and spending time on this issue. Life is too short!

Re: bad surprise - beolab 6000 frets on ebay

    Hey Ralf,

who would buy frets in such condition ? Selling them in this condition doesn't make sense to me. The only option I see would be to rebuild them with new fabrics, as mentioned here on the forum, and sell them as refurbished.

What really sucks is loosing money to such a betrayer who will sell items in the future and I don't think that a bad comment will stop him doing so.

The seller didn't even reacts on opening a case on ebay, so I see no way to get a refund, even not a partial one.

New frets are around 220-240 Euros.

Re: bad surprise - beolab 6000 frets on ebay

Just offer them here (Leslie? :-))...

In the end 145 euro of ebay or 220 from b and o is a simple decision or not?!?

Accept the loss and go on to the next important issue in your life ;-))

Open an ebay case and leave a bad comment and that is it.

    Ralf

PS: I once bought a stereo system for a kindergarten that was almost not wrapped/packed at all... again, I believe if you did not pay via paypal only option is to give a bad comment, sorry.

Re: bad surprise - beolab 6000 frets on ebay

Looks like there comes some moving in the case.

After opening a case on ebay, the seller answered one day later. He wanted to have some pictures of the damages.

After receiving my pictures he found out that hasn't seen the damages I described as he said and either he will take back the frets and give me a full refund or I take the frets and he gives me a partial refund.

How much are the damaged frets worth ? Should I take the full refund or should I take the frets with a partial refund ? Is it worth to rebuild the frets with the fabric which Soren talked about in another thread here ? Costs for the fabrics are around 20 Euros.

On my current beolab 6000 frets the are some minor damages to the fabric on the top and on the bottom of the frets and something like a shadow in the fabric which looks like oil/grease or something like that on one fret.

What do you guys think ?

IMHO, however easy people claim the reclothing will be, they will not look original, so...

    • Do you want frets that look factory new? -> buy new frets from B&O
    • Can you live with the minor defects in the ones you bought? -> get a partial refund, maybe spend 15 minutes for a makeover (cut away the sticking threads)...
    • Do you think you can get better looking frets by DIY reclothing? -> do that to your current frets and return the ones you bought

My advice is to send the eBay ones back and order some new ones from B&O.
